Man Arrested for Assault and Child Abuse After Smashing Ice Cream Shop Window in San Jose

San Jose police have arrested Payam Afsari, 36, in connection with an incident involving assault, child abuse, and vandalism. The incident occurred on April 26 at approximately 5:30 p.m. at an ice cream shop in the 2900 block of Aborn Square.

Surveillance footage captured the alarming moment when Afsari allegedly smashed a window, causing large shards of glass to fall on a child inside the shop. The video shows the child and their guardian entering the shop and sitting near the window just seconds before Afsari runs up and breaks it from the outside.

Following the incident, the child and their guardian immediately left the premises. Police have not disclosed whether the child sustained any injuries and have yet to identify the child or guardian involved.

Detectives later identified Afsari as the suspect and obtained an arrest warrant. He was apprehended on May 15 at his San Jose residence and booked into the Santa Clara County Main Jail on charges of assault with a deadly weapon and child abuse.
