Breyers Ice Cream is poised to distribute nearly $9 million as part of a class action settlement regarding its Natural Vanilla flavor. On September 13, the Supreme Court of New York State, Bronx County, announced the agreement involving Conopco Inc. and Unilever United States Inc., Breyers’ parent company.
The lawsuit claims that Breyers’ Natural Vanilla ice cream misrepresented its flavor, suggesting it was derived solely from real vanilla. According to the court’s statement, “Plaintiffs allege that the labeling of Breyers Natural Vanilla ice cream misled consumers into believing it contained vanilla flavor exclusively from the vanilla plant, rather than from non-vanilla sources.” The defendants deny these allegations and assert that they have not engaged in any wrongdoing, with the court not having made a final determination on the matter.
Eligibility for Compensation
Consumers who purchased Breyers’ Natural Vanilla ice cream between April 21, 2016, and August 14, 2024, may qualify for compensation from the settlement fund of $8.85 million. Eligible consumers will receive $1 for each carton of ice cream purchased, as established by the court. To claim compensation, consumers must provide proof of purchase. Those with valid receipts can submit an unlimited number of claims, while customers without proof of purchase can file up to eight claims, potentially earning up to $8 in total.
New Product Formula Requirement
In addition to the financial settlement, the court has mandated that Breyers develop a new product formula within one year of the settlement’s conclusion, ensuring it excludes vanilla sourced from non-vanilla origins.
