The Museum of Ice Cream is facing legal challenges following claims that its popular “Sprinkle Pool” has led to multiple injuries. Emily Robinson filed a lawsuit alleging she fractured her ankle after jumping into the attraction during her visit on March 24, 2022. The lawsuit, filed in Manhattan Supreme Court on October 16, states that Robinson required surgery due to what she describes as “severe and permanent injuries” sustained from her fall into the pool.
The Museum of Ice Cream promotes itself as a “safe space” on its website, encouraging visitors to “dive into fun” in their iconic sprinkle pool. However, the experiences of some patrons tell a different story.
In August, another customer, Jeremy Shorr, lodged a separate lawsuit against the museum, claiming he also suffered a significant ankle fracture requiring surgery and the installation of internal hardware after visiting the sprinkle pool in March 2023. Shorr’s legal representation argues that the pool’s design is flawed, stating that the shallow rainbow-colored sprinkles fail to provide a safe landing for jumpers.
“We believe this sprinkle pool poses a risk of serious personal injury to members of the public,” said Daniel Perrone, the attorney representing both Robinson and Shorr.
Social media has further highlighted these incidents. TikTok user Carlie Noelle shared a video, which garnered three million views, showing her jumping off a mini diving board and landing painfully on her tailbone in the sprinkles. “I wasn’t expecting it to hurt so bad,” she captioned the post. Another viral TikTok, with 11.3 million views, shows three teenage girls falling into the sprinkle pool, one of whom winces and clutches her ankle after landing.
The Museum of Ice Cream, which opened in July 2016 as a pop-up in New York City’s Meatpacking District, has yet to respond to requests for comment regarding the lawsuits. Robinson is seeking unspecified damages for her injuries.
